We Were Right – Health Care Bill Is Not About Health Care After All!

Well, I have done it! I have read the entire text of: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.

To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and
other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.

The Bill will also eventually force private insurance companies out of business, and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats, and most of them
will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled by the government.

However, as scary as all of that is, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated. If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.

The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people, and the businesses they own.

The irony is that the Congress doesn’t have any authority to legislate in most of those areas to begin with! I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.. This legislation also provides for access, by the appointees of the Obama administration, to all of your personal healthcare information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a direct violation to protection against unreasonable searches and seizures. A direct violation of the specific provisions of the 4th Amendment to the Constitution. You can also forget about the right to privacy.

That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide. If you decide not to have healthcare insurance, or if you have private insurance that is not deemed acceptable to the Health Choices Administrator appointed by Obama, there will be a tax imposed on you. It is called a tax instead of a fine
because of the intent to avoid application of the due process clause of the 5th Amendment.. However, that doesn’t work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the due process of law.

So, there are three of those pesky amendments that the far left hate so much, out of the original ten in the Bill of Rights, that are effectively nullified by this law It doesn’t stop there though.

The 9th Amendment that provides: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people; The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any
rights or powers at all in many areas that once were theirs to control.

I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights. Article 6 of the Constitution requires the members of both houses of Congress to “be bound by oath or affirmation to support the Constitution.” If I was a member of Congress I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable.

For those who might doubt the nature of this threat, I suggest they consult the source, the US Constitution, and Bill of Rights. There you can see exactly what we are about to have taken from us.

Obama sneaks into back door to avoid 2000+ Tea Party protesters….in downtown San Francisco!!!

Today president Obama paid a visit to the Westin St. Francis in San Francisco for a $2 million dollare DNC fund raiser.   However, the interesting news is not what went on at the $15,000 a plate dinner inside the hotel .  Outside, over 2000 Tea Party protesters swarmed the sidewalks to voice their opposition to big government, runaway spending, oppressive regulations and gave overwhelming opposition to Obama’s healthcare “reform” plans. 
 
On the streets, Obama supporters were easily outnumbered by conservatives by at least 8:1.  Leading up to the event, well dress DNC donors attending the fund raiser were seen walking into the hotel, eyes bugged and jaws agape as they looked onto the sea of Tea Party protesters.  You can be sure that the DNC and local Obama organizers will be getting calls of concern from these deep pocket attendees tomorrow.
 
During the event conservative protesters chanted slogans using bull horns and voices.  Patriotic songs were frequently sung by the crowd and the Pledge of Allegiance was said on at least 3 occasions.  Meanwhile down the street, anti-war protesters played with bongo drums.
 
One protester on the scene, David, called into a local conservative talk show and announced “the Belly of the liberal beast [San Francisco] must have some serious indigestion right now….  Conservatives have taken over Union Square!”.  Another caller reported seeing Obama in his limo entering the hotel via the back entrance.  It was obvious that Obama’s handlers could not allow imagery of Obama being massively protested in the most liberal city in America.  Instead, they had to “sneak him in the back door”!

 

Overall, the action was an overwhelming success for the Tea Partiers.  This despite attempts by the city of San Franciso to discourage protesters attendance with claims that another event was happening at Union Square.  The event did happen, and the protest did not interfere.  Additionally, some trepidation was  heard within local conservative chat groups about proper permitting and concern that liberal counter protesters might get “aggressive”.  Principled and committed conservatives in the area took action and reminded patriots that our cause is much bigger than these petty worries and in the end both of these concerns proved false.  The Tea Partiers had every right to peacefully assemble on the sidewalks and the few Obama supporters on the scene generally kept to themselves, most likely because they were badly outnumbered.    I observed no incidents of aggressive behavior on either side.  It was a protest the way it should be.  And, oh yeah, we Tea Partiers even cleaned up after ourselves.
 
Conservatives in San Francisco, the Bay Area, and from all over California have shown America that the liberal agenda to reconstruct America into a socialist state no longer has a safe harbor in San Francisco.   As usual, the liberal media has mostly ignored the significance of this event.  That is why I’m writing this tonight.  To encourage conservatives everywhere the keep up the fight.  Resist at every opportunity and to speak up and speak without fear.  We can and will take our country back and return it to our founding principles.  The journey will be long and at times challenging, but it is a journey we conservatives must take together.

API Starts Energy Tomorrow Blog

I have some news to share with you – today API officially launched the EnergyTomorrow Blog.

As I stated in my inaugural post, I’m hoping that this blog will be informative, timely and that it will encourage a respectful debate. The posts will cover a variety of energy-related topics, and we’ll give particular focus to explaining how these issues relate to our nation’s economic interests. The blog will feature materials and commentary containing content that you might not find elsewhere, including energy industry statistics, technological advancements, as well as our views on policy decisions. I’ll be the primary contributor, but we’ll also be featuring guest posts from API’s President Jack Gerard and other industry experts.

Ultimately, my vision for this blog is that it will serve as a truly participatory “meeting of the minds,” so feel free to share your thoughts and concerns about energy. I also welcome any feedback you have on topics you’d like to see covered and the overall usefulness of the blog.

Daily Rant Part 2 – February 6, 2009

There is too much floating around in my head to limit my rant to one today. After listening to the radio all day, Rush’s show with his guest host, Sean’s show, Levin’s show, I can’t believe that some Republicans are not listening. Perhaps it is because liberal weenies like Olympia Snowe of and Susan Collins, both of Maine and both Republicans In Name Only keep getting re-elected. We would be better represented if they lost to Democrats next election… but I digress.

These two turncoats do not deserve to be called Republicans. They often vote with Democrats on many bills anyway, and this “Stimulus” bill, which has grown to over $1 Trillion, will probably pass the Senate with their votes. If that happens, conservatives need to do a full court press to unseat them next election. They could switch parties and the results would be the same.

How Much Is Enough?

First it was $700 Billion for the stimulus that grew to over $1 Trillion. How much is enough? And if this bill is so important to stimulate the economy, why is there very little in there that will do so? Most of it is pork that Democrats have been wanting to pay for pet projects. They want to eat the whole pig all in one bite! Actually, they ARE the pigs! Oink, oink!

The Huffington Post has an article with the entire bill, all 647 pages of it. I tried to grab it off their site, but was unsuccessful. Besides, it starts with a flawed premise that our economy is the worst since the great depression. Bull! There are also links to summaries of the bill in the article. If you look at the programs, many are liberal causes like alternative energy projects… not something that is going to significantly boost the economy. It’s more throwing a bone to the environmental crowd who support Democrats. This is what our congressmen and women have agreed to spend our money on?

Senator Arlen Spector of Pennsylvania is another potential traitor. He was also in the meeting with Snowe and Collins while Harry Reid was shopping for votes to avoid a FiIibuster on the “Porkulus” bill. If this thing goes, we will actively campaign against any Republican who supports it.

Even the buget office, run by Democrats, say this bill is a turkey. But Obama wants something, so we are going to create a new bumper sticker:

“Obama – From Bad To Worse”

This is in honor of the bailout and stimulus that he supported. Remember, in another month, this economy is his. And when this piece of crap bill fails to do what they are promising, Democrats will be on the hook. Republicans who oppose this will be in a good position in the 2010 election. They could even regain the majority in both houses if this fails as miserably as we think it will. People will be really ready for “change”!

Credit Card Forgiveness Programs

All I hear on the radio are advertisements for clearing up consumer debt through these credit corporations. As someone who filed for bankruptcy many years ago, I can tell you there is nothing honorable about this. For years we ran up consumer debt on credit cards until we owed so much, there was no way we could pay it back. We filed for bankruptcy and it ruined my credit for 10 years afterward.

If I had learned the lesson it would be one thing. But did that teach me anything? NO! Several years later I went out and did it again. It took me another 3 years to clean that mess up. I was on my own so the amount was smaller, but the result of not managing my money was the same.

What can we expect when our leaders are spending into the trillions, money they don’t have and will need to borrow or print. How responsible is that? People watch our so-called “leaders” and follow their lead. There is no responsibility from anyone. “It’s not my fault,” is the current outcry.

Back to the debt forgiveness. A blog called Sound Money Matters explains this phenomenon:

Why Credit Card Debt Forgiveness is Bad

Simply forgiving up to 40% of credit card debt is bad for three reasons:

  1. This debt was accrued by choice. The typical debt is not the result of a medical emergency or falling home values. It’s a result of people buying stuff they can’t afford and then deciding not to pay off the bill at the end of the month. People who have their credit card debt forgiven without going through some kind of difficult process, like bankruptcy, won’t learn to budget. They’ll just wind up in this situation all over again.
  2. We already have a system to forgive credit card debt. They call it bankruptcy. If you qualify, judges can reduce or eliminate credit card debt. If you don’t, then you get put into a payment plan. This plan applies to the types of situations where people would file bankruptcy, but without the pain or the process.
  3. Banks don’t need the government’s permission to write down losses. They can do that it already, but they want the government to change accounting rules so that writing down credit card losses is advantageous to the banks. So, now the banks won’t learn a lesson either. No one made them issue those credit cards. They knew the risks, and they should accept the consequences.

This is part of the bailout! You and I are paying for this with tax money!

Al Franken Is A Big Fat Idiot

The fact that Democrats let Al Franken steal his election and are seating him proves they have no integrity. To them it is all about winning, not about fairness. It is insulting to me that they will count more votes in a state than there are voters and not demand a special election. Al Franken is a low-life scum bag who failed on Air America but did not go down with the ship!

Why Are All The Statesmen Southerners?

Seems to me that policitians are from the north and statesmen are from the south. Why is that? Country gentlemen? All the Senators and Congressmen who called in to the talk radio shows this morning were from southern states like Virginia and Kentucky, and all were against the stimulus package. Unfortunately there are not enough of them to stop this catasprophe. Ask yourself, how will we pay for this? If they print money then what’s in your wallet will be worth less. Too many dollars chasing too few goods.

Keep Blaming Bush

Whatever happened to “the buck stops here”? Obama and his followers are still trying to blame Bush for the current climate. Why is it then for the first 6 years he was in office we enjoyed record growth and a booming economy? It was only when Democrats came into office for the last 2 years that we started to have problems. But people didn’t see that, and now we have ALL Democrats running the 3 branches of government. It sucks for the 50% of us who DIDN’T vote for this.

Rahm’s “Opportunity” Hurts The Rest of Us

This stimulus bill is being hastily enacted just as Rahm Emanuel predicted. He said Obama would take advantage of these bad situations and get legislation passed that they would normally have a hard time getting through. The rhetoric that “we have not seen an economy like this since the great depression” (truth is, since the Carter administration… this is nothing like the depression) and great minds like Pelosi say we are going to lose “500 million jobs a month if this doesn’t get passed” (though we only have 125 million or so in the workforce! What an ASS!) is fear mongering of the worst sort and is meant to scare people into calling their representatives asking to get this bill passed… It’s not really working. Otherwise there wouldn’t be so much resistance and this bill would have been passed quickly.

Fairness Doctrine

Finally, the fairness doctrine is nothing of the sort. What it is, is an attempt to silence political commentary that goes against what liberals want to hear. Remember when Hillary Clinton said opposition was patriotic? And remember when Democrats were talking about rights of the minority party… when they were the minority party? Ask yourself, what will it COST?

Daily Rant Part 3 – January 28, 2009

Apparently I have a lot of random thoughts to rant about today, but, let’s face it. This recession SUCKS! And no president or government can get us out of it. It will take lots of entrepeneurs to get us out of this mess. But that’s not what we’re being told. Despite the fact that Bush’s stimulus didn’t work, we are told that this one will! Fool me one, shame on you. Fool me twice, shame on me!

What has been proposed in this “Stimulus” package is PORK! This is quid pro quo; payback for political promises Obama made to his liberal left who got him elected. Every special interest group has its hand out, and now it’s time to pay up!

An independent blogger has made an analysis on his own. The site is www.ideapalooza.com and shows how campaign promises are turning into cash and will do nothing to stimulate the economy! Here’s an excerpt from today’s blog:

I continue to marvel at both the media and pundits discussions regarding the Barack Obama Stimulus Package.  They wonder how things like money for the Arts and money towards Pell Grants can have any immediate impact on the ailing economy.  What are items like this doing in a stimulus package?

My Barack Obama Promise Tracker file contains 895 campaign promises culled from all of Mr. Obama’s speeches and his Plan for America. This file is downloadable, shareable, contains links to original sources and has a keyword search function.

Fantastic! Obama wanted transparency. Then let’s start with his term as President. I am betting it’s all HOT AIR! What with the accomplices in the media who refuse to do any real reporting, most people will NEVER know what is really going on!

Democrats Seem To Have No Standards

On a related topic, nobody seems to care when Democrats break the law. Look at Timothy Geithner who fails upward. After not paying his income taxes, he gets nominated and confirmed as Secretary of the Treasury… in CHARGE of the IRS! This alone should embarass the President. But it doesn’t.

Then there’s Governor Rod Blagojevich. What a scumbag. Though he is seriously tainted, he refuses to let go of his power! That really says a lot, and is how I feel about MOST politicians, but particularly Democrats.

But it’s not just Democrats. In California we have a Republicrat as governor. In the past week he has guaranteed to threaten jobs in the auto industry by proposing the most stringent clean air standards that our car companies, who are already in trouble, can not easily adapt to. What a genius! No wonder businesses are leaving California in DROVES! Doesn’t he see how that mass migration affects the tax that’s being collected? And what about the budget? Politicians, mostly Democrats, are spending more money every year than they are taking in. So when the Governor went to Washington to ask for a hand out, it kind of says it all, doesn’t it?

But let’s give everyone who buys a Prius (or Pious as we like to call them) or a Smart Car gets a tax CREDIT! Money we don’t have! And I heard that these cars are NOT even in the top 100. It’s hard to believe when, in Marin County where I live, every third car is a Pious! Try driving that in the mountains with 4 kids and your ski gear! Amazing.

Finally let’s talk about the Lottery. It was put into place by promising that the excess money would go to schools. Yeah, right. It is another form tax, voluntary I will admit, but a tax none the less. Did you know… that winners of the lottery instead of taking the full amount in timed payouts, they can cash out for a much lower dividend. Then that money is treated as W-2 income and taxed again! Robert Kiyosaki calls it 50% money.

I will admit we play the lottery every week. Once I win I will take that money and start a foundation for educating underpriveleged kids in finances. That’s where our country has fallen down. Instead of teaching kids basics, our public education system is teaching them about global warming and putting condoms on bananas. How about teaching them something that will help them get out of the financial situation they’ve been born into? Of course, if we don’t turn back this liberal tide, there won’t be any jobs left to be had. And it won’t make sense to start our own businesses!
